»Regulatory Discretion. A Critical Reconstruction«: The thesis researches the transfer of the Regulatory Discretion developed for telecommunications law to energy law. Since this transfer has led to a loss of legal protection, a new form of discretion called Subsumption Discretion is introduced into the discourse in order to describe the specific administrative activity in energy regulation, which has to create competitive market conditions, without loss of legal protection for market participants.
