»Cost-Conscious Proportionality Doctrines. A Contribution to the Issue od Measures that are Sparing with Individual Freedom, But More Expensive for the State« This study is dedicated to a segment of the dogmatics of the constitutional proportionality principle. A more detailed analysis is made of constellations in which a state measure is only necessary (»erforderlich«) because the milder alternative is more expensive for the state. It is shown that a cost avoidance purpose must have a bearing on the scrutiny of proportionality to ensure that the decisive value judgement can be conducted within the expediency/means ratio in a comprehensible manner.
