»The German Federal Court of Justice and the So-Called Stepped Protection Concept Within the Framework of Sec. 22 and 23 par. 1 no. 1 KUG« This paper deals with the case law of the German Federal Court of Justice on the right to one's own image. It shows that the results of the case law are not in line with the interests at stake and the protection of personality is not sufficiently considered. The work answers the question of when contemporary historical events exist that allow the publication of images without the consent of the person depicted within the framework of the relevant standards of German law.
